1. Preamble

SAS Yescapa (registered office is located at 75-79 Cours du Médoc, 33300 Bordeaux), in its capacity as data controller, attaches great importance to respecting and protecting your privacy and your personal data.

All data collected may only be used for the purposes set out in this privacy policy and the General terms and conditions of sale and use of the Yescapa site and service.

The purpose of this "Privacy Policy" is to inform you about the processing of your data related to your use of the Yescapa Platform.

2. Definitions

Reviews": Comments and/or assessments made by a User concerning a Vehicle and/or another User published at the end of a contractual relationship between Users.

Rental Contract": Contract by which an Owner transfers the use of a Vehicle for a specified time and Price. It sets out the conditions agreed between the parties during the said rental period.

Personal Data": any information relating to an identified or identifiable natural person (hereinafter referred to as "Users"); an "identifiable natural person" is one who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more factors specific to his or her physical, physiological, genetic, mental, economic, cultural or social identity.

Platform": Website and mobile application offered to our users to access the Yescapa service.

Profile": Data voluntarily provided by a User when registering on the Site or during use of the Site.

Owner": Includes all Vehicle Owners wishing to offer their Vehicles for hire on the Site. The Owners concerned are those whose occasional Vehicle rental activity is carried out on a private basis and does not constitute a main source of income, or those whose Vehicle rental activity is carried out on a professional basis and constitutes a main source of income.

Remuneration": A sum of money paid by the Traveller to the Owner of a Vehicle in return for the provision and hire of the Vehicle.

Reservation": Action taken by a Traveller in order to retain a Vehicle and obtain the use of it for a certain period of time agreed with the Owner.

Data Controller" or "YESCAPA Company ", determines the purposes and means of the processing; where the purposes and means of such processing are determined by Union law or the law of a Member State, the Data Controller may be designated or the specific criteria applicable to its designation may be provided for by Union law or by the law of a Member State.

Company": The YESCAPA Company.

User": Includes both Owners and Passengers.

Vehicle": Motorised Land Vehicle (MLV) or motor home of category LV or HGV benefiting from insurance in accordance with the legal requirements laid down for this purpose.

3. Data collection and use

3.1. Creating a Profile and entering into a Rental Agreement

We collect your personal information when you provide it at the time of a Booking, when you contact us (for example, by using the contact form or when you send an email) or when you create a Profile. We use your information to set up contracts and to process your Reservations. After deleting your account, your data will no longer be accessible and will be deleted after the mandatory storage period, unless you have expressly consented to subsequent use. You may delete your Profile at any time. You can do this yourself by clicking on "delete your Profile permanently" in your dashboard or you can request this by form or by e-mail, as indicated in Article 6 of this Privacy Policy.

When you make your Booking, we ask you for your destination. This enables us to check that the insurance will cover you throughout your journey, even if you are travelling through several countries.

To insure your rental, we also need personal documents. These documents are not visible to the public and are only used for internal processing to check identities and to fulfil the functions set out in article 4 of the general terms and conditions of use :

  • Identity card
  • Driving licence
  • Proof of address (not required for the rental of Vehicles registered in Germany)

3.2 Publishing an advert

To publish an advert, you will be asked to provide information about your Vehicle and yourself. Some of this information is visible on the site to help Renters choose their motorhome or van. Other information is invisible and is used to insure your Vehicle correctly or to pay your Remuneration:

Concerning the Owner (invisible) :

  • Identity card: To verify identity (KYC) and for customer service management;
  • Business owner: ID card of the manager or legal representative to check identity (KYC) and for customer service management.
  • Vehicle registration document: to check that the vehicle complies with the official administrative registrations, and therefore with road traffic regulations;
  • Green card: to check that the vehicle is insured;
  • Technical inspection: Check that the vehicle meets all the legal/technical requirements for road use;
  • Bank details: information needed to enter the remuneration package;
  • Hire authorisation (when the Hirer/Seller and the Owner are two different people);
  • Kbis (less than 3 months old) for professional Owners;
  • Declaration of Economic Beneficiaries" document for Professional Owners (requested by our partner MangoPay).

3.3 Banking and identity details

In order to conclude the Rental Agreement between a Renter and an Owner, bank details may be recorded by our various payment service providers. This may include credit card details for making payments on our site and IBAN/BIC details (for receiving transfers).

In addition, KYC verification (Know Your Customer: more information via this link) requires us to have a service provider validate the identity documents of our Users. All our service providers also comply with GDPR.

Our payment service providers are :

Mangopay: Provider enabling secure monetary management of Bookings with regard to the collection and payment of Remuneration.

Paypal: Service provider enabling secure payments to be made via connection to an account on their Platform by bank card or direct debit.

Klarna: Service provider that enables secure payments to be made via connection to an account on their Platform by direct debit.

Floabank: Provider of secure micro-credit payments (in 4 installments).

All banking information is collected, encrypted, and stored on the secure servers of our service providers. All this data can only be used for useful purposes in the execution of the services offered by Yescapa.

4. Time limits for storing your personal data

4.1. Personal data

Your personal data is kept for a period of 3 years from the last use of our Platform. After this period, your personal data will be deleted, except in the cases set out in Article 4.3.

4.2. Documents

Identity documents (driving licence, identity card and proof of address) are kept for a period of 6 months from the expiry date of the rental contract.

4.3. Financial and billing data

Financial and billing data will be kept for a period of 10 years, as required by applicable tax and accounting laws.

5. Use of newsletter data

By subscribing to our newsletter, you authorise us to use the data you have provided to send you the newsletter by e-mail on a regular basis. Unsubscribing from the newsletter is possible at any time and can be done either via a link provided in the newsletter or via our contact form, or directly on the Yescapa website under the heading "My account" then "Profile".

6. Your rights concerning the use of your personal data

You have rights concerning the use of your personal data. They are explained on the various points indicated in this article 6. These rights are available in sections 6.1 to 6.8. Articles 6.8 and 6.9 explain how to exercise these rights.

6.1. Right to information

You have the right to information on the use of your personal data. This right takes the form of this Privacy Policy.

6.2. Right to object

If you do not wish your data to be used for direct marketing activities, market research or any other specific purpose, you have the right to object. We respect your choice and undertake to stop using your data for these purposes immediately.

6.3. Right of access

You have the right to know what data we hold about you, how it is processed and for what purpose. We will provide you with a document setting out this data.

This document will be communicated to you within a maximum period of 1 month.

6.4. Right of rectification

You may request the rectification of inaccurate or incomplete information concerning you. We may, however, retain certain information about you for a legal reason or for a compelling reason that requires us to do so in order to protect ourselves or a user against possible fraud or a suspected breach of our terms and conditions.

6.5. Right to erasure

You may request the deletion of your personal data. We may, however, retain certain information about you for a legal reason or for a compelling reason that requires us to do so in order to protect ourselves or a user against possible fraud or a suspected breach of our terms and conditions.

We are also obliged by law to retain part of your data for the purposes of invoice retention for a period of 10 years.

This request will be processed within a maximum of 1 month.

6.6. Right to portability

You have the right to receive a copy of the personal data you have provided to us in a structured, commonly used and machine-readable format. This right allows you to transfer this data to other services or platforms of your choice.

6.7. Right to limit processing

You have the right to request that your personal data be limited rather than deleted. In this case, we will ensure that your data is no longer processed for purposes other than storage.

8. Creating and accessing accounts

When you register on the site, you can choose from several options. You can register using your email address and a password (8.1.) or use a tool such as Apple Connect (8.2.) or Facebook Connect (8.3.).

8.1. Your password

You are responsible for keeping your password confidential. It is therefore crucial that you never share your password with third parties and that you keep it strictly confidential.

We strongly encourage you to choose a strong password, made up of a combination of letters, numbers and special characters, and to update it regularly.

In case of doubt or suspicion of unauthorised access to your account, please contact us immediately.

8.2. Information on using Apple Connect

We offer the ability to connect to our platform via Apple Connect, providing a smoother registration and login experience. When you choose this option, we may collect certain limited information from your Apple account, such as your first and last name, in order to facilitate the registration process and to ensure the accuracy of your data.

The email used for your Yescapa account will be automatically generated by Apple and will therefore mask your personal email address. Our service may use this email address to communicate with you. This email address redirects to your personal email address. In this way, you are likely to receive our communications directly to your email inbox thanks to the redirection made by Apple.

Please note that we strictly adhere to Apple's privacy policies, and we do not collect, use or share any other sensitive information from your Apple account without your explicit consent.

8.3. Information on using Facebook Connect

Facebook Connect is a service of Facebook, Inc. Use of Facebook Connect is subject to Facebook's privacy policy and terms of use. When you use Facebook Connect, certain data (your surname, first name and e-mail address) from your Facebook profile is transmitted to Yescapa. This data is stored and processed by SAS Yescapa for registration on the Platform. By registering on the Yescapa Platform via Facebook Connect, you consent to the transfer of your Facebook Profile data to Yescapa. In addition, you authorize Yescapa to use this data.

9. Use and moderation of your messages

We may take note of messages sent between users, in particular in order to prevent cases of fraud, to help our users, to deal with behaviour deemed inappropriate or to check that users are complying with our general terms of use.

This verification only takes place in compelling cases and is not carried out for commercial, marketing or statistical purposes. We would like to remind our users of our desire to keep their personal data and comments as confidential as possible.

We may update this Privacy Policy periodically to reflect changes in our data processing practices. Updates will be posted on our website and the date of the last update will be indicated at the bottom of the page. We encourage you to periodically review this Privacy Policy for any updates.
